By accessing our Website, browsing its content, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use our Website or purchase our products.
These Terms apply to all visitors, users, and customers of the Website. They are governed by the laws of Ireland and the applicable laws of the European Union.

3. Eligibility
You must be at least 18 years of age to purchase products from our Website. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are purchasing on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
Our products are intended for consumers only. Resale of Vishpha Beauty products without our prior written consent is prohibited.
4. Product Information and Availability
We make every reasonable effort to ensure that product descriptions, images, ingredient lists, and pricing are accurate at the time of publication. However, we do not warrant that product descriptions or other Website content is error-free, complete, or current. Product images are for illustrative purposes only and may differ slightly from actual products.
All products are subject to availability. We reserve the right to discontinue, modify, or limit the availability of any product at any time without notice. Where a product becomes unavailable after your order has been confirmed, we will notify you promptly and offer a full refund or suitable alternative.
All Vishpha Beauty products are cosmetic products as defined under EU Cosmetics Regulation (EC) No 1223/2009. They are not medicinal products and are not intended to treat, cure, or prevent any medical condition.
5. Pricing and Currency
All prices are displayed in Euros (€) and are inclusive of applicable Irish VAT unless otherwise stated. Prices are correct at the time of publication and may be changed at any time without prior notice. The price you pay is the price shown at the time of checkout — any changes to pricing will not affect orders already confirmed.
For customers outside the Republic of Ireland, local import duties, customs charges, or taxes may apply and are the sole responsibility of the recipient. We are not responsible for any customs delays or charges imposed by the recipient's country.
We comply with IOSS (Import One-Stop Shop) requirements for EU cross-border shipments with a value of €150 or less.
6. Orders and Formation of Contract
When you place an order on our Website, you are making an offer to purchase the selected product(s) at the displayed price, subject to these Terms. An order confirmation email sent to you does not constitute our acceptance of your order — it is an acknowledgement that we have received it.
A legally binding contract between you and La Branche Limited is formed only when we send you a dispatch confirmation email, or when your order is handed to the shipping carrier, whichever is earlier.
We reserve the right to refuse, cancel, or limit any order at our sole discretion, including (but not limited to) cases where: a pricing error has occurred; a product is out of stock; we suspect fraudulent activity; or we are unable to verify payment. If we cancel your order after payment, we will provide a full refund within 14 days.
7. Payment
We accept Visa, Mastercard, Apple Pay, Google Pay, and any other payment methods displayed at checkout. All payment transactions are processed securely by Stripe Payments Europe, Ltd, a PCI-DSS compliant payment processor. We do not store, process, or transmit your card details on our own servers at any point.
Full payment is required at the time of placing your order. By providing payment details, you authorise us to charge the total order amount to your chosen payment method. All transactions are subject to Stripe's Terms of Service.
In cases of suspected fraudulent transactions, we reserve the right to require additional verification before processing an order and to cancel any order that we reasonably believe to be fraudulent.
8. Shipping and Delivery
We dispatch orders from Ireland within 1–2 business days of payment confirmation. Estimated delivery times are provided at checkout and in our Shipping & Returns Policy. These are estimates only — we cannot guarantee delivery within specific timeframes, particularly for international orders subject to customs clearance.
Risk of loss and title for products passes to you upon delivery to your specified address. If a parcel is returned to us due to an incorrect address provided by you, we may charge redelivery costs. We are not responsible for delays, loss, or damage caused by the postal or courier service after dispatch.
If your order has not arrived within the expected delivery window, please contact us at hello@vishphabeauty.com with your order number and we will investigate.
9. Right of Withdrawal and Returns
As a consumer in the EU, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with the EU Consumer Rights Directive 2011/83/EU (as transposed into Irish law by the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013).
To exercise your right of withdrawal, you must notify us in writing (email is sufficient) at hello@vishphabeauty.com within the 14-day withdrawal period. You must then return the product(s) within a further 14 days of notifying us.
Conditions for return: Products must be returned unused, undamaged, and in their original sealed packaging. For hygiene reasons, we cannot accept returns of cosmetic products that have been opened or used unless the product is faulty, damaged, or not as described. This exception does not limit your statutory rights.
Refunds: Upon receiving and inspecting the returned goods, we will process a full refund of the product price within 14 days. Refunds will be made to your original payment method. We may withhold a refund until we have received the returned goods or until you have provided evidence of return, whichever is earlier.
Return shipping: The direct cost of returning goods is your responsibility, except where the product is faulty, damaged, or incorrectly supplied — in which case we will cover return shipping costs and provide a prepaid label.

10. Faulty, Damaged, or Incorrect Products
If you receive a product that is faulty, damaged in transit, or does not match what you ordered, you must notify us at hello@vishphabeauty.com within 7 days of delivery, including photographic evidence of the issue. We will arrange a free replacement, exchange, or full refund at no cost to you, including return shipping if applicable.
Your statutory rights under the EU Sale of Goods Act and Consumer Rights Directive are not affected by these Terms. Products must conform to the contract of sale — they must be of satisfactory quality, fit for purpose, and as described. Where goods do not conform, you are entitled to repair, replacement, or refund under applicable Irish and EU consumer law.
11. Product Use, Safety, and Cosmetic Compliance
All Vishpha Beauty products are cosmetic products compliant with EU Cosmetics Regulation (EC) No 1223/2009. They are for external use only. Always read the full ingredient list (INCI) on each product before first use. We recommend performing a 48-hour patch test on the inner arm before applying any new product to your face.
Do not use products on broken, irritated, infected, or severely inflamed skin. Keep all products out of reach of children. Do not ingest. If a product comes into contact with your eyes, rinse thoroughly with clean water. If irritation, allergic reaction, or discomfort occurs, discontinue use immediately and consult a qualified healthcare professional.
We are not liable for adverse reactions arising from: (a) misuse of the product; (b) failure to perform a patch test; (c) use on contraindicated skin conditions; (d) combination with other products not recommended by us; or (e) failure to follow product instructions.
Our products are not intended to diagnose, treat, cure, or prevent any medical condition. If you have a skin condition or are under dermatological care, consult your healthcare provider before use.
12. Website Use and User Conduct
You may use this Website only for lawful purposes and in accordance with these Terms. You agree not to:
(a) use the Website in any way that violates any applicable local, national, or international law or regulation;
(b) transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material;
(c) knowingly introduce any viruses, trojans, worms, or other material that is malicious or technologically harmful;
(d) attempt to gain unauthorised access to any part of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website;
(e) reproduce, duplicate, copy, sell, or exploit any part of the Website content without our express written permission.
We reserve the right to suspend or terminate your access to the Website at any time if you breach these Terms or engage in conduct that we consider harmful, abusive, or contrary to applicable law.
13. Intellectual Property
The Website and all its content — including but not limited to text, articles, photographs, product images, graphics, logos, icons, audio clips, digital downloads, data compilations, and software — are the exclusive property of La Branche Limited or its content suppliers, and are protected by Irish copyright law and EU intellectual property legislation.
You are granted a limited, non-exclusive, non-transferable licence to access and view the Website for personal, non-commercial use only. You must not reproduce, distribute, modify, transmit, republish, display, perform, or create derivative works from any content on this Website without our prior written consent.
The VISHPHA BEAUTY name, logo, product names, and any other brand identifiers used on this Website are trade marks of La Branche Limited. Use of these trade marks without our prior written permission is strictly prohibited.
14. Limitation of Liability
To the fullest extent permitted by applicable Irish and EU law, La Branche Limited shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses arising out of or in connection with your use of our Website or products.
Our total aggregate liability to you in respect of any claim arising out of or in connection with these Terms or your use of the Website shall not exceed the total value of the order giving rise to the claim.
Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by sections of the Sale of Goods Acts (as amended) or equivalent EU consumer legislation; or (d) any other liability that cannot be excluded or limited by law.
These Terms do not affect your statutory rights as a consumer under Irish law or EU consumer protection legislation.
15. Indemnification
You agree to indemnify and hold harmless La Branche Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Website, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

We have no control over the content or privacy practices of those websites and accept no responsibility or liability for them. 20. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes) shall be governed by and construed in accordance with the laws of Ireland.
Subject to Section 19 above, the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. However, as a consumer in the EU, you retain the right to bring proceedings in the courts of the country in which you are domiciled.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
